Welcome to TrainShare! These Terms & Conditions ("Terms") govern your use of the TrainShare mobile application ("the App") provided by TrainShare ("we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1.1 Agreement to Terms: By accessing or using the App, you agree to be bound by these Terms and all terms incorporated by reference. If you do not agree to all of these Terms, you may not access or use the App.
1.2 Changes to Terms: We reserve the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting the updated Terms on the App. Your continued use of the App after the posting of the updated Terms constitutes your acceptance of the changes.
2.1 License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.
2.2 User Conduct: You agree to use the App only for lawful purposes and in accordance with these Terms. You further agree not to:
3.1 User Consent: By using our location-sharing feature, you consent to share your current location with us. You acknowledge that you have the option to enable or disable location sharing at any time through the app settings.
3.2 Accuracy of Location Information: Users location shared with the TrainShare may be considered as train location. While we make efforts to provide accurate location information, we cannot guarantee the accuracy, completeness, or reliability of the location data shared by users.
3.3 Invalid Location Status: You agree not to provide false, inaccurate, or misleading location information. We reserve the right to suspend or terminate your access to location-sharing features if we suspect fraudulent or improper use.
4.1 Use of Chatbox: Our chatbox messaging feature allows users to communicate with each other. You agree to use this feature responsibly and in accordance with our community guidelines.
4.2 Content Responsibility: You are solely responsible for the content of your messages. We do not endorse or control the content exchanged through the chatbox and disclaim any liability for such content.
4.3 Prohibited Activities: You agree not to use the chatbox for any unlawful, abusive, harassing, or otherwise objectionable purposes. We reserve the right to remove any content that violates these Terms.
5.1 Third-Party Advertisements: Our platform may display advertisements from third-party advertisers. We do not endorse or guarantee the products or services advertised and disclaim any liability for third-party advertisements.
5.2 Ad Content: We reserve the right to determine the placement, content, and frequency of advertisements displayed on our platform. Advertisements should comply with our content guidelines and applicable laws.
5.3 User Interaction: Any interaction or transaction with third-party advertisers is solely between you and the advertiser. We are not responsible for any issues arising from interactions with advertisers.
6.1 Ownership: The App, including all content, features, and functionality, is developed by TrainShare and is intended to be protected by copyright, trademark, and other intellectual property laws. While copyright registration is still in process, TrainShare asserts ownership of all the intellectual property related to the App. Upon completion of the copyright process, the App will be formally protected under applicable copyright laws.
6.2 Restrictions:You agree not to modify, reproduce, distribute, create derivative works of, publicly display, or publicly perform any portion of the App without our prior written consent, regardless of whether the formal copyright process has been completed.
Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
8.1 No Warranties: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8.2 No Guarantee of Results: We do not guarantee that the App will be error-free, uninterrupted, or free of viruses or other harmful components. We also do not guarantee any specific results from the use of the App.
IN NO EVENT SHALL TRAINSHARE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
10.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law principles.
10.2 Dispute Resolution: Any dispute arising out of or related to these Terms or your use of the App shall be resolved exclusively through arbitration in accordance with the rules of the Bangladesh International Arbitration Centre (BIAC). The arbitration shall take place in Dhaka, Bangladesh, and the language of the arbitration shall be either Bengali or English, depending on mutual agreement.
